REGULAR MEETING OF SDDC – SCEDFA – FOSCO GIVING OPINIONS TO A DRAFT DECREE TO REPLACE CURRENT DECREE No. 75/2014/NĐ-CP

On 3rd June 2020, a meeting was held at the Han River Hotel in Da Nang, between the three organisations authorized by the Ministry of Foreign Affairs to recruit and manage Vietnamese employees working for foreign individuals and organisations in Viet Nam, including the Service Department for Diplomatic Corps - SDDC, the Service Company to Foreign Missions - FOSCO, and the Service Centre for Da Nang Foreign Affairs - SCEDFA. The purpose of the meeting was focused on giving comments for a draft Decree to replace the current Decree No.75/2014/NĐ-CP.


Attending the meeting were representatives of the Ministry of Public Security’s Foreign Security Department (A01) in Ha Noi and Da Nang, the Da Nang Department of Public Security’s External Security Division (PA01), the Da Nang Department of Foreign Affairs, and the Ministry of Foreign Affairs’ Department of Foreign Affairs Provincial. The meeting was co-chaired by Mr. Nguyen Trac Ba - Director of SDDC, Mr. Tran Quang Thao - Chairman of FOSCO’s Board of Members, and Mr. Tran Hieu - Director of SCEDFA.


The achievements obtained during the implementation of Decree No. 75/2014/NĐ-CP in the 2015-2019 period highlighted great efforts by the three organizations in improving professional skills and promoting PR activities to enhance the quality of recruitment, introduction and management of Vietnamese employees working for foreign individuals and organisations.


At the meeting, Mr. Nguyen Tho Xuong, Acting Manager of the Division of Labour Management for Diplomatic Corps – SDDC, pointed out some problems during the implementation including the legal corridor, insufficient cooperation of foreign individuals/organizations and the relevant authorities, the limited number of manpower, and improper funds for the 3 organisations to operate during the 5 years of implementation. Mr. Nguyen Tho Xuong also presented some suggestions to enhance the quality of recruitment, introduction and management of Vietnamese employees.


A summarized report of comments on amendments to the draft Decree to replace current Decree No. 75/2014/NĐ-CP proposed by the 3 organisations was presented at the meeting, with a view to improving the legal framework for the recruitment, introduction and management of Vietnamese employees working for foreign individuals and organisations. A heated discussion took place afterwards. Several questions related to amendments to the draft Decree were raised by representatives from the three organizations. Emphasis has been attached to the need of adding the following to the draft decree: the units providing services of supplying human resources and outsourcing Vietnamese employees to foreign individuals and organisations should be included; sanctions should be amended for those violating the regulations; responsibilities of the Vietnamese employees and relevant authorities should be clarified clearly; the policy about training and improving skills and knowledge for the Vietnamese employees should be added.


The participants’ opinions about the draft Decree would be collected, summarized and sent to the authorized Committee to study, revise and submit to the Prime Minister for consideration, and a new Decree is expected to be issued soon.
